POLÍTICA DE PRIVACIDAD – Plataforma de médicos

Para dar cumplimiento a las obligaciones dispuestas en la Ley 34/2002, de Servicios de la Sociedad de la Información y del Comercio Electrónico (LSSI-CE) y a la Ley Orgánica 3/2018 de Protección de datos y Garantía de Derechos Personales (LOPDGDD) , AXIS PHARMA S.L. – en adelante EL TITULAR - pone a disposición de los usuarios la siguiente información:

El USUARIO será aquella persona física o jurídica que acceda y/o use cualquiera de los servicios de AXIS PHARMA S.L. por cualquier medio sin necesidad de registrarse. Mediante la aceptación de esta cláusula, el Usuario acepta la Política de Privacidad reflejadas en el presente documento.

2. ¿CON QUÉ FINALIDAD TRATAMOS SUS DATOS PERSONALES?

AXIS PHARMA realiza el tratamiento de sus datos personales con la finalidad de ejecutar los contratos que tengan suscritos o para prestar la información o servicios que solicite el usuario; y exclusivamente aquellos necesarios para la finalidad por la que se recabaron.

A tal objeto, el USUARIO deberá consentir expresamente la recepción de cualquier tipo de comunicación comercial, así como en todos aquellos formularios de recabo de datos publicados en su página web, marcando el correspondiente recuadro de verificación que se dispondrá en cada caso.​

3. DATOS TRATADOS

AXIS PHARMA realiza el tratamiento de sus datos con la finalidad de ofrecerle la participación en estudios médicos que pueden ser remunerados y que puedan ser de su interés, así como la ejecución, en su caso, de los contratos de participación en los mismos y su facturación. Los datos se conservan mientras el profesional de la medicina sea apto para participar en los estudios para los que se les contacta. En general, AXIS PHARMA trata los siguientes datos de los médicos participantes en los estudios: Datos identificativos: nombre y apellidos, número de colegiado, dirección postal, dirección de correo electrónico, número de teléfono móvil. Datos financieros: número de cuenta bancaria para el abono de la cantidad pactada. Datos profesionales: especialidad médica, centro de trabajo. Los datos recogidos por AXIS PHARMA se obtienen desde bases de datos de acceso público o por cesión de terceros autorizados a tal efecto; en este sentido, AXIS PHARMA bloquea los datos hasta obtener la verificación y el consentimiento de los titulares dentro del plazo legalmente establecido.

3. ¿HASTA CUANDO SE CONSERVARÁN MIS DATOS?

AXIS PHARMA conservará los datos recogidos durante el periodo estrictamente necesario para cumplir con la finalidad que motivó el tratamiento, sin perjuicio del período de conservación que en cada caso proceda de conformidad con la legislación vigente. Los Datos de los Usuarios que hayan consentido la recepción de newsletters, u ofertas de servicios o propuestas de celebración de estudios de mercado o proyectos de consultoría, objeto de negocio de AXIS PHARMA, se conservarán desde que el Usuario preste su consentimiento hasta que lo revoque o ejercite sus oportunos derechos.

4. ¿CUÁL ES LA LEGITIMACIÓN PARA EL TRATAMIENTO DE SUS DATOS?

AXIS PHARMA tratará los datos de los USUARIOS para remitirles comunicaciones comerciales, responder a sus solicitudes de información, prestar servicios y la ejecución de estos contratos, o analizar los documentos que remitan los candidatos a empleos. Los datos de Profesionales Sanitarios serán tratados por AXIS PHARMA para remitirle las ofertas de participación en estudios de mercado en base al consentimiento prestado por ellos. En caso de que se llegue a suscribir el contrato para la participación en un estudio concreto, AXIS PHARMA tratará sus datos personales para gestionar la ejecución de tal contrato.

5. ¿A QUÉ DESTINATARIOS SE COMUNICARÁN MIS DATOS?

Los datos se tratarán de manera confidencial y en ningún caso serán cedidos a terceros salvo requerimiento expreso por las Administraciones Públicas, de conformidad con la normativa vigente.

6. ¿CUÁLES SON SUS DERECHOS CUANDO NOS FACILITA SUS DATOS?

6.1 Ejercicio de los Derechos

Usted podrá ejercitar en cualquier momento, mediante correo electrónico o carta certificada con acuse de recibo a la dirección de correo postal que se indica en el apartado correspondiente al Responsable del Tratamiento, los siguientes derechos Derecho de acceso: Usted tendrá derecho a obtener confirmación de si se están tratando o no datos personales que le conciernen, y cierta información sobre dicho tratamiento. Derecho de rectificación: Usted tendrá derecho a obtener la rectificación de aquellos datos personales que le conciernan y sean inexactos. Derecho de supresión: Usted tendrá derecho a obtener la supresión de sus datos, que AXIS PHARMA estará obligada a ejecutar sin dilaciones indebidas. Derecho a la limitación: Usted tendrá derecho a limitar el tratamiento de sus datos personales que, en consecuencia, únicamente podrán ser objeto de tratamiento por AXIS PHARMA para la formulación, el ejercicio o la defensa de reclamaciones. Derecho a la portabilidad: Usted tendrá derecho a solicitar de AXIS PHARMA la remisión a otro responsable de los datos que le haya facilitado. Para poder facilitarle el ejercicio de los derechos, será necesario acreditar que es el titular de los mismos mediante un documento oficial acreditativo, indicando el derecho que quiere ejercer, así como los datos afectados.

6.2 Revocación del Consentimiento

En cualquier momento podrá revocar el consentimiento prestado por usted, a través de los medios reseñados en el primer apartado.

In general, AXIS PHARMA will keep the following information of the people participating in the medical market research studies: Identificative data: name, surname, number from its collegiate body, email address, mobile phone number. Finantial information: bank account number for the payment of remunerated studies. Profesional data: medical specialty, work center.

4. FOR HOW LONG WILL MY DATA BE KEPT?

AXIS PHARMA will keep the data collected during the period strictly necessary to fulfill the purpose that motivated the treatment, without prejudice to the conservation period that in each case proceeds in accordance with current legislation. The Data of Users who have consented to the receipt of newsletter or offers of services or proposals to perform consultancy or market research studies, business objects of AXIS PHARMA, will be kept from the moment the User gives his consent until he revokes it.

5. WHAT IS THE LEGITIMATION FOR THE TREATMENT OF YOUR DATA?

AXIS PHARMA will process your data to send you commercial communications, respond to your requests for information, or provide services and their respective contract execution, by the consent given by the USER of AXIS PHARMA services.

The data of health professionals will be processed by AXIS PHARMA in order to send them offers of participation in market research studies, based in the consent provided by them. In the event of participation in a specific study, after the signature of the contract AXIS PHARMA will process their personal data to manage the execution of such contract.

6. TO WHOM WILL MY DATA BE COMMUNICATED?

The data will be treated confidentially and in no case will be transferred to third parties unless expressly requested by the Public Administrations, in accordance with current regulations.

7. WHAT ARE YOUR RIGHTS WHEN YOU PROVIDE US WITH YOUR DATA?

7.1 Exercise of Rights
